“SMIRNOFF IBA WIN A TRIP TO CROATIA” PROMOTION TERMS AND CONDITIONS

  1. Information on how to enter and the prize(s) form part of these Terms and Conditions. Participation in this promotion is deemed acceptance of these Terms and Conditions. All prize values stated in these Terms and Conditions are inclusive of GST where applicable, and expressed in AUD, unless specified otherwise.

  2. Entry is only open to Australian residents aged 18 years or over.

     

  3. Employees (and their immediate families) of the Promoter, Participating Stores (defined below) and agencies associated with this promotion are ineligible to enter. Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or 1st cousin.

     

  4. Entries into the promotion open and close at each Participating Store as below:

     

    • The Bottle O: Opens on 28/10/2024 and closes at 11:59pm AEDT on 10/11/2024;

    • IGA Liquor: Opens on 06/11/2024 and closes at 11:59pm AEDT on 19/11/2024; and

    • Cellarbrations Liquor: Opens on 04/11/2024 and closes at 11:59pm AEDT on 17/11/2024.

       

      (collectively referred to as “Promotional Period”).

       

  5. A “Participating Store” is any Cellarbrations, The Bottle-O and IGA Liquor store nationally that advertises the promotion and stocks the Eligible Product (defined below) during the Promotional Period.

  6. To be eligible to enter, individuals must spend $30 or more in a single transaction on any Smirnoff product/s (“Eligible Product”) at a Participating Store during the Promotional Period and obtain a purchase receipt (“Qualifying Transaction”). If a staff member does not automatically hand the individual a purchase receipt after making a Qualifying Transaction, it is the individual’s responsibility to request one.

     

  7. To enter, individuals must then visit www.cellarbrations.com.au, www.thebottle- o.com.au or www.igaliquor.com.au (depending on where the Qualifying Transaction was made), follow the prompts to the promotion entry page, input the requested details, upload the purchase receipt, and submit the fully completed entry form during the Promotional Period.

  8. Multiple entries permitted, subject to the following: (a) only one (1) entry permitted per Qualifying Transaction regardless of the amount spent on Eligible Products in excess of $30; (b) each entry must be submitted separately and in accordance with entry requirements; and (c) only one (1) entry permitted per person per day.

     

  9. Entrants must retain their original purchase receipt(s) for all entries as proof of purchase. Failure to produce the proof of purchase for all entries when requested may, in the absolute discretion of the Promoter, result in invalidation of ALL of an entrant’s

    entries and forfeiture of any right to a prize. Purchase receipt(s) must clearly specify the store of purchase and that the purchase was made during the Promotional Period but prior to entry.

     

  10. The Promoter reserves the right, at any time, to verify the validity of entries and entrants (including an entrant’s identity, age and place of residence) and reserves the right, in its sole discretion, to disqualify any individual who the Promoter has reason to believe has breached any of these Terms and Conditions, tampered with the entry process or engaged in any unlawful or other improper misconduct calculated to jeopardise fair and proper conduct of the promotion. Errors and omissions may be accepted at the Promoter's discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights. The Promoter's legal rights to recover damages or other compensation from such an offender are reserved.

     

  11. Incomplete or indecipherable entries will be deemed invalid.

     

  12. If there is a dispute as to the identity of an entrant, the Promoter reserves the right, in its sole discretion, to determine the identity of the entrant.

     

  13. The draw will take place at 3 Amy Close, Wyong NSW 2259 on 03/12/2024 at 1:00pm AEDT in the presence of an independent scrutineer. The Promoter may draw additional reserve entries and record them in order in case an invalid entry or ineligible entrant is drawn. The winner will be notified by phone and email within two (2) business days of the draw and their first initial, surname and postcode will be published in https://www.diageopromotions.com.au/ on 05/12/2024.

     

  14. The Promoter’s decision is final and no correspondence will be entered into.

  15. The first valid entry drawn will win a trip for two (2) adults to Split, Croatia valued at up to AU$17,000 depending on date and point of departure. Prize includes:

    • 2 x return economy airfares from winner's nearest capital city to Split, Croatia;

    • Private return Airport transfers in Split, Croatia;

    • 2 x night double share accommodation in a minimum four star accommodation in Split, Croatia;

    • 7 x nights on the Deluxe Party Week Cruise (double share accommodation) including exclusive beach parties at various Croatian islands, snorkelling, island hopping, and water sports activities;

    • AU$1,000 spending money (winner only) in the form of an electronic funds transfer to the winner’s nominated Australian bank account; and

    • Comprehensive travel insurance for two people (subject to all travellers having no pre-existing medical conditions and being under the 59 years of age).

       

      Additional spending money, meals, taxes (excluding airline and airport taxes), insurance, passports, visas, vaccinations, transport to and from departure point, transfers, items of a personal nature, in-room charges and all other ancillary costs are not included. Prize must be taken by 30/10/2025 and is subject to booking and flight availability. Prize cannot be taken during Australian school holidays, public holidays or other peak periods.

       

  16. The Deluxe Party Week Cruise component is not available for people aged 36 or older. If the winner or their companion is 36 years of age or older, the Promoter will substitute the component with another experience of equal value or specification.

  17. The winner and their companion must depart from and return to the same departure point and travel together. Frequent flyer points will not form part of the prize. Prize is subject to the standard terms and conditions of individual prize and service providers. The winner may be required to present their credit card at time of accommodation check in. The winner must select a guest with a minimum age of 18.

  18. Once the prize has been claimed, the winner and guest/s will be required to complete a further prize booking form including liability and publicity waiver within one (1) month of the date that they successfully claimed the prize and were verified as the valid winner. The winner must finalise the prize booking within two (2) months of successfully claiming the prize and being verified as a valid winner, and the travel must be booked at least sixty (60) days prior to the intended travel departure date. All travel must be completed within twelve (12) months of the prize draw. Travel itinerary will be determined by the Promoter in its absolute discretion.

     

  19. The winner and their of their companion will each be required to fully complete a travel insurance application form provided by the Promoter, and may also be required to undergo medical tests as required by the Promoter’s nominated travel insurer, in order to redeem the travel insurance element of the prize. Any person found guilty of insurance fraud or failure to honestly and accurately disclose all relevant insurance information at the time of applying for a travel insurance policy or when making a claim forfeits any rights or entitlements to the travel insurance element of the prize. Travel insurance will be provided by the Promoter’s nominated travel insurer, and subject to approval by the travel insurer. In the event that the Promoter’s nominated travel insurer refuses to issue insurance to the winner or companion, the winner forfeits that travel insurance element of the prize. Travel insurance is subject to the terms and conditions issued by the Promoter’s nominated travel insurer, including but not limited to any limitations on the covered amount.

     

  20. In the event of war, terrorism, state of emergency, pandemic or any other kind of disaster, the Promoter reserves the right to cancel, terminate, modify or suspend the promotion or suspend, substitute or modify a prize, subject to any written directions from a relevant regulatory authority.

     

  21. Winner is responsible for providing full and accurate bank details. The Promoter will not be responsible for incorrect details being provided, a banking institution rejecting an EFT payment, or any costs associated with locating any lost monies.

  22. The winner of the Deluxe Party Week Cruise prize and their companion acknowledge that the prize includes dangerous activities (“Activity”) that may result in injury or death and participate at their own risk. The winner and their companion must: (a) attend, undergo and pass any appropriate training, briefings, required medical tests and other requirements of the Promoter and Activity organisers as determined by them in their absolute discretion; (b) not have any heart condition or history thereof, or other medical conditions that would make it dangerous to participate in any Activity; (c) not be under the influence of drugs or alcohol; (d) comply with all directions of the Promoter and Activity organisers at all times; and (e) wear all safety and other equipment required. The Promoter and Activity organisers, in their absolute discretion, at all times reserve the right to: (a) prevent any winner or their companion from participating in any Activity if, at any time, they reasonably believe that the winner or their companion poses a safety risk or for any other reason; and/or (b) cancel the Activity if the conditions are deemed dangerous. If any Activity is varied for any reason beyond the control of the Promoter it may not be rescheduled and no compensation will be offered.

  23. The Promoter advocates the responsible service and consumption of alcohol. The Promoter encourages consumers to drink responsibly. Legal aged consumers are advised to visit www.drinkwise.org.au to get the facts on standard drinks and responsible drinking.

  24. Subject to the unclaimed prize draw clause, if for any reason a winner does not take the prize (or an element of the prize) at/by the time stipulated by the Promoter, then the prize (or that element of the prize) will be forfeited.

     

  25. If the prize (or part of the prize) is unavailable, the Promoter, in its discretion, reserves the right to substitute the prize (or that part of the prize) with a prize to the equal value and/or specification, subject to any written directions from a regulatory authority.

  26. Total prize pool value is up to $17,000.

     

  27. Prize, or any unused portion of the prize, is not transferable or exchangeable and cannot be taken as cash, unless otherwise specified.

  28. A draw for the prize, if unclaimed, may take place on 13/01/2025 at the same time and place as the original draw, subject to any directions from a regulatory authority. The winner, if any, will be notified by email and phone within two (2) business days of the draw and their name will be published at https://www.diageopromotions.com.au/ on 15/01/2025.

     

  29. Entrants consent to the Promoter using their name, likeness, image and/or voice in the event they are a winner (including photograph, film and/or recording of the same) in any media for an unlimited period without remuneration for the purpose of promoting this promotion (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter.

  30. The winner and their companion agree that they will not sell or otherwise provide their story and/or photographs to any media or other organisation apart from the Promoter or Mavel Group.

     

  31. If this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, including but not limited to technical difficulties, unauthorised intervention or fraud, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law: (a) to disqualify any entrant; or (b) subject to any written directions from a regulatory authority, to modify, suspend, terminate or cancel the promotion, as appropriate.

     

  32. Any cost associated with accessing the promotional website is the entrant’s responsibility and is dependent on the Internet service provider used.

  33. The use of any automated entry software or any other mechanical or electronic means that allows an entrant to automatically enter repeatedly is prohibited and will render all entries submitted by that entrant invalid.

     

  34. Nothing in these Terms and Conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act, as well as any other implied warranties under the ASIC Act or similar consumer protection laws in the States and Territories of Australia (“Non-Excludable Guarantees”). Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its

    respective officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the promotion.

     

  35. Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) is not responsible for and excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in prize value to that stated in these Terms and Conditions; (e) any tax liability incurred by a winner or entrant; or (f) use / taking of the prize.

     

  36. As a condition of accepting the prize, the winner (and their companion) must sign any legal documentation as and in the form required by the Promoter and/or prize suppliers in their absolute discretion, including but not limited to a legal release and indemnity form.

     

  37. The Promoter collects personal information ("PI") in order to conduct the promotion and may, for this purpose, disclose such PI to third parties, including but not limited to agents, contractors, service providers, prize suppliers and, as required, to Australian regulatory authorities. Entry is conditional on providing this PI. The Promoter will also use and handle PI as set out in its Privacy Policy, which can be viewed at https://www.diageopromotions.com.au/privacy-policy. In addition to any use that may be outlined in the Promoter’s Privacy Policy, the Promoter may, for an indefinite period, unless otherwise advised, use the PI for promotional, marketing, publicity, research and profiling purposes, including sending electronic messages or telephoning the entrant. The Privacy Policy also contains information about how entrants may opt out, access, update or correct their PI, how entrants may complain about a breach of the Australian Privacy Principles or any other applicable law and how those complaints will be dealt with. All entries become the property of the Promoter. Unless otherwise indicated by the Promoter, the Promoter may disclose PI to entities outside of Australia (for a list of the countries, see the Promoter’s Privacy Policy), and cannot guarantee that any overseas recipient will not breach the Australian Privacy Principles. By entering the promotion entrants consent to the overseas transfer on these terms as permitted by the Australian Privacy Principles and agree that the Promoter is not liable in this regard.
